Mortgage fraud and the elderly in New Mexico

In two civil lawsuits filed Friday morning the New Mexico Attorney General is asking a judge for immediate action to stop foreclosures on the two properties.

Both incidents involve elderly residents.

In one suit is based on a Los Lunas couple who said they gave money to their brokers and bank to pay off bills. They claimed that money never made it to creditors and that they were cheated and overcharged by their mortgage company.

In the second case, Chimayó, a woman earning approximately $500 a month was given a $1500 per month mortgage. She claims her signature was forged.

A news release from the attorney general identified the defendants in the Chimayó suit as Deutsche Bank, US Bancorp, Saxon Mortgage Brokerage, North American Specialty Insurance Co., Orlinda Martinez, Angelica Duran and Mountain View Mortgage

Defendants named in the Los Lunas case are Zia Trust Co, Discount Mortgage Co., Hartford Insurance Co., Wendy and Mike Montoya and Robert L. Garretson.
